1. Summary

CherryFans is an adults-only (18+) creator subscription platform. All content must comply with this policy. Violations result in content removal, account suspension, or permanent ban.

The content line is approximately equivalent to Pantry (팬트리) in South Korea: topless and lingerie content allowed; genital exposure, sexual acts, and any depiction of minors are absolutely prohibited regardless of mosaic, blur, or covering technique.

2. Allowed Content (within Pantry-equivalent line)

2.1 Photography & Video

  • ✅ Topless with mandatory nipple mosaic (must cover with mosaic / pasties / strategic positioning — exposed nipples not allowed)
  • ✅ Lingerie, bikini, swimwear, sheer fabric

  • ✅ Solo provocative content (e.g., touching self over clothing)

2.2 Chat & Messages

  • ✅ Flirtatious dialogue
  • ✅ Romantic / intimate language
  • ✅ Sensory descriptions (e.g., "just got out of the shower")
  • ✅ Light role-play (girlfriend / boyfriend / friend dynamic)
  • ✅ Adult-themed conversation within consent and 18+ framing

2.3 Marketing & Profile

3. Prohibited Content

3.1 Strictly Prohibited (instant ban + report to authorities)

The following content is never allowed under any circumstances. Discovery results in immediate permanent ban, balance forfeit, and report to applicable authorities (NCMEC, KCSC / 방심위, FBI, 한국 사이버수사대 등).

  • ❌ CSAM — any sexual content involving anyone under 18 (real or AI-generated, drawn or photographic)
  • ❌ Non-consensual intimate imagery — revenge porn, hidden camera, imagery without explicit consent of the depicted person
  • ❌ Deepfakes of real identifiable people without their explicit consent (성폭력처벌법 위반)
  • ❌ Bestiality — sexual content with any animal
  • ❌ Trafficking content — content suggesting coercion, prostitution, or forced labor
  • ❌ Necrophilia — content depicting deceased subjects sexually
  • ❌ Snuff content — content depicting actual harm or death

3.2 Prohibited (warning + content removal)

The following content is not allowed. Removal counts as a strike toward suspension/ban (see Strike System below).

Sexual depiction

  • ❌ Genital exposure (vulva, penis, anus) — even when:
    • Mosaicked / pixelated / blurred
    • Behind sheer fabric
    • Partial / off-frame
  • ❌ Pubic hair displayed in sexual context
  • ❌ Sexual acts depicted:

  • ❌ Erotic depictions of self-harm, drug use, violence, or underage scenarios

Sourcing & rights

  • ❌ Stolen content — images/videos you don't own or aren't licensed to publish
  • ❌ Copyrighted material without permission (DMCA)
  • ❌ Content you don't have explicit consent to publish from depicted persons
  • ❌ AI-generated content imitating real identifiable people without their permission

Other prohibited

  • ❌ Hate speech, racial slurs, religious harassment
  • ❌ Promotion of violence
  • ❌ Promotion of illegal substances
  • ❌ Promotion of self-harm or eating disorders
  • ❌ Spam, repetitive content, gibberish

3.3 Borderline / Restricted

These require special consideration:

  • ⚠️ Roleplay scenarios (teacher-student, parent-child) — must be clearly framed as adult fantasy with age-appropriate language. No references to minors.
  • ⚠️ "Looks young" — even if creator is verified 19+, content emphasizing the appearance of youth (school uniforms, plush toys, etc.) may be removed at moderator discretion
  • ⚠️ Group photography — all members must be 19+ verified through our KYC; no sexual interaction depicted
  • ⚠️ Sex toys — allowed in profile photos, banned in active use

4. Creator Verification Requirement

UGC creator uploads are currently restricted to residents of South Korea (다날 휴대폰 본인인증 통과자). Global expansion is planned for a later phase. Payment from viewers worldwide is supported.

To upload content, you must complete identity verification:

  1. Korean mobile-phone identity verification (다날 휴대폰 본인인증) — verifies legal name, date of birth (must be 19+ in Korean age), gender, and Korean residency
  2. Signed 2257 record consent — required for U.S. legal compliance and retained 7 years
  3. Korean tax form — 사업자등록증 (사업자) or 사업소득 3.3% 원천징수 동의 (사업자 미등록)
  4. Korean bank account for payouts

Identification data is stored encrypted (AES-256), retained per 18 U.S.C. § 2257 (7 years post-publication) and Korean tax law (5 years), and never shared except as required by law.

5. Content Restrictions by Type

5.1 Profile Picture (avatar)

  • Must be your own face / likeness or AI-generated character (clearly disclosed)
  • Cannot include genital exposure
  • Cannot be misleading (e.g., using another creator's photo)

5.2 Posts (feed photos / videos)

  • Within Pantry content line (above)
  • Caption ≤ 500 characters
  • No links to external adult sites (we'll handle revenue, not affiliate)
  • Tags must be relevant

5.3 Direct Messages (DMs)

  • Same content rules as posts
  • PPV photo unlocks subject to all post rules
  • No spam, no copy-paste mass DMs

5.4 Bio & Profile Description

  • Must be in plain language
  • Cannot promise specific behavior we cannot enforce
  • Cannot include external payment links (Cash App, Venmo, 토스, 카카오페이 등)
  • Cannot include phone numbers or street addresses

6. Strike System

Violations are tracked per creator account:

  • Strike 1 — Warning email, content removed
  • Strike 2 — Warning email, 24-hour suspension
  • Strike 3 — 7-day suspension
  • Strike 4 — 30-day suspension
  • Strike 5 — Permanent ban + balance forfeit

After 90 days of clean record, strike count decreases by 1 per month. Severe violations (CSAM, non-consensual content) bypass the strike system entirely.

6.1 Appeal Process

  • Email cherryfans777@gmail.com within 7 days of action
  • Include: account handle, content URL or screenshot, explanation
  • Response within 5 business days
  • Decisions can be reversed if the reviewer made a factual error

7. Reporting Violations

Anyone can report content that violates this policy:

7.1 Priority response

  • CSAM / non-consensual: 1 hour
  • Underage user: 6 hours
  • Copyright / DMCA: 24 hours
  • Other: 72 hours

False reporting at scale (e.g., bot reporting) may result in account suspension.

8. Government Compliance

8.1 Korea (정보통신망법, 청소년보호법, 형법 243-244조)

  • 19+ identity verification required for all users (다날 휴대폰 본인인증)
  • 청소년 유해 매체물 표시 displayed on all adult-content pages
  • 24-hour response to KCSC (방송통신심의위원회 / 방심위) takedown orders
  • Compliance officer designated per 정보통신망법 47조의2
  • 방심위 신고: 1377 / kocsc.or.kr

8.2 United States (18 U.S.C. § 2257, FOSTA, DMCA)

  • 2257 records retained 7 years post-publication
  • Custodian of records published on the 2257 statement page
  • DMCA agent registered with the U.S. Copyright Office
  • NCMEC reporting for any CSAM (mandatory)

8.3 European Union (GDPR, DSA)

  • GDPR-compliant data handling
  • DSA transparency reports (when applicable)
  • "Highly effective" age verification for EU users (per UK OSA / EU DSA)

9. Special Provisions

9.1 AI-generated content

  • AI-generated personas are part of the platform offering
  • AI personas cannot imitate real identifiable people
  • The same content line applies to AI content (no genital exposure, sexual acts, etc.)
  • AI personas are owned by CherryFans, not by users

9.2 Cross-platform content (UGC creators)

  • You may post the same content on other platforms (OnlyFans, Pantry, etc.)
  • We do not claim exclusivity
  • However, you cannot link from CherryFans to external paid platforms (drives chargebacks)

9.3 Live content (future feature)

  • All live broadcasts subject to the same content rules
  • Real-time moderation; recordings reviewed afterward
  • Severe violations during a live session = immediate stream termination + ban

10. Changes to This Policy

  • Material changes communicated via email + in-app notice
  • 30-day notice before changes take effect (except emergency changes required by law)
  • Continued use after changes constitutes acceptance
