DMCA Copyright Policy
CherryFans LLC ("CherryFans") respects intellectual property rights and complies with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to submit copyright complaints and counter-notices.
1. Filing a DMCA Notice (Takedown Request)
If you believe content available on cherryfans.com infringes your copyright, please send a written notice to our Designated Agent that includes all six of the following:
- A physical or electronic signature of the copyright owner or an authorized agent;
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works);
- Identification of the material that is claimed to be infringing, with sufficient detail (URLs) to allow us to locate it;
- Your contact information: name, address, telephone number, and email;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Email is the fastest method. Subject line should begin with: [DMCA TAKEDOWN].
3. Our Response
Upon receipt of a properly formatted notice, we will:
- Remove or disable access to the allegedly infringing material, typically within 24 hours;
- Notify the user who posted the material and forward a copy of your notice;
- Terminate the accounts of repeat infringers in accordance with § 512(i).
4. Filing a Counter-Notice
If you believe your content was removed in error or as a result of misidentification, you may submit a counter-notice including:
- Your physical or electronic signature;
- Identification of the material that was removed and its location before removal;
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your name, address, telephone number, and consent to the jurisdiction of the U.S. Federal District Court for Wyoming (or the federal court covering your address if outside the U.S.) and acceptance of service of process from the original complainant.

5. Repeat Infringer Policy
We terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Three substantiated takedowns within twelve months will result in account termination.
6. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please ensure your notice or counter-notice is accurate and made in good faith.
